Case Study: Countering Counterfeiting
One of our clients is a startup in the highly competitive beauty industry. They developed a unique product, which was protected by registered design rights.
During a visit to a trade fair in China, our client noticed a series of cheap imitations of their product. Moreover, they discovered a shipping container full of the imitations was heading to the UK.
One law firm advised the client that it would be impossible to find the shipment.
Fearing the market would soon be flooded with counterfeits, the client sought a second opinion from our IP lawyers. We advised that, through our network, we could hunt down the name of the ship transporting the goods and issue a notice with UK customs.
The client instructed us to move ahead, and we were able to get the shipment seized upon arrival. Furthermore, customs provided us with the details of the importer, to whom we issued a cease and desist letter.
We were then able to negotiate a favourable settlement with the importer, which included both monetary compensation and valuable evidence to use against the production factory in China.
