What is intellectual property?

Intellectual property rights are legal protections for creations of the mind, including artistic, literary and musical works, designs, inventions, and business assets, like brand names, logos, and even trade secrets. Common forms of intellectual property legal protections include trade marks, copyright and patents.

An intellectual property lawyer helps individuals and businesses properly register, protect, and manage their IP assets through various non-contentious (e.g. registering a right) and contentious (e.g. fighting an infringement) work. This is vital for ensuring owners of IP maximise the commercial value of their work.

Case Study: Countering Counterfeiting

One of our clients is a startup in the highly competitive beauty industry. They developed a unique product, which was protected by registered design rights.

During a visit to a trade fair in China, our client noticed a series of cheap imitations of their product. Moreover, they discovered a shipping container full of the imitations was heading to the UK.

One law firm advised the client that it would be impossible to find the shipment.

Fearing the market would soon be flooded with counterfeits, the client sought a second opinion from our IP lawyers. We advised that, through our network, we could hunt down the name of the ship transporting the goods and issue a notice with UK customs.

The client instructed us to move ahead, and we were able to get the shipment seized upon arrival. Furthermore, customs provided us with the details of the importer, to whom we issued a cease and desist letter.

We were then able to negotiate a favourable settlement with the importer, which included both monetary compensation and valuable evidence to use against the production factory in China.

Frequently Asked Questions

How are your fees structured?

Before any fees, we’ll first schedule a consultation to listen and learn more about your situation. The session is free, and there are no obligations to engage our services afterwards. As part of the consultation, we’ll lean on our 25+ years of experience as a specialist IP law firm to suggest the best solution for you or your business.

We’ll be completely transparent about your legal standpoint, what needs doing to achieve your desired outcome, and how long it might take. At this point, we’ll provide a fixed-fee quote for our work.

We’ve found our fixed-fee approach works well for many businesses and individuals, including those with more modest resources, so please do get in touch.

What can you help me with?

Our lawyers can help you protect or monetise your intellectual property, fight any infringements, defend claims against you, and far more. This falls across a range of types of intellectual property, from branding to designs to confidential information. We can help you:

  • Identify all of your IP assets and find the best means of protecting them
  • Develop a strategy for protecting your IP in the UK and worldwide
  • Protect your brand, designs, creative works, confidential information, and inventions
  • Monetise your IP through licensing or transferring ownership
  • Acquire the rights to the IP of other companies and individuals
  • Investigate and resolve infringements, whether you’re bringing forward a claim or defending one
  • If necessary, support you through court proceedings

What should I do if someone is infringing my intellectual property rights?

If you believe someone is infringing your IP rights, you should collect as much evidence as you can. Good examples of evidence include screenshots, website links, and photos. In short, anything that captures and demonstrates the infringement. Next, you should speak to an intellectual property lawyer, who can advise whether you have grounds for a complaint and what steps to take next.

Who owns your IP?

For some startups intellectual property is their main asset. But if you are not careful, one of your most valuable assets might not actually belong to your company.
